From a press release out of the Senate President Pro Tem's office:

Jon Bauman (i.e. "Bowzer" of Sha Na Na) will testify before the Senate Judiciary Committee on Senate Bill 146. S.146 is designed to protect consumers from the deceitful promotion of "imposter groups"...

Senate Bill 146, introduced by Senators Alice Nitka and John Campbell, intends to expose the "Great Pretenders" of doo-wop and rock 'n roll revival performances in Vermont. The bill, which has passed in 20 states and, likely to pass in 10 more this year, is designed to stop unscrupulous concert promoters from deceiving the public with "imposter groups" which have no connection to the original recording artists or groups.

I remember reading about this a while ago. As one who likes a lot of older music, I see this phenomenon quite often and have even seen a band or two that had maybe one original member, and often one that was nominal or marginal at best.

"This is a form of copyright and trademark protection.

The reason it would be important to Vermonters is the same reason
truth in advertising laws exist - to prevent fraud.

There are examples of people forming a band and using an older
group's name (or a single member breaking off and trying to take the
name with them).

If you see "The Supremes" are to play at the state fair, as a
consumer you would rightfully expect that one or more of the original
members of the group would be there performing. If you paid your
money and then found out that it was, in fact, a cousin of one of the
original members and two friends, you might feel taken advantage of.

This has been happening in various forms for a while, so pushing for
this kind of protection (for the original bands and their fans) makes
sense."

I suppose this could be a problem in Vermont.... especially with all the county fairs and such.

One of the many things I do with my time is organize the Northeast Kingdom Music Festival in East Albany.  One of the most important aspects to establishing these kinds of things is being able to meet the challenge of legitimacy.  This is constantly undermined by scam-artists who are just trying to capitalize on someone else's name and reputation.  When we say we have a certain band or performer, the value in that is people's trust and understanding that that is exactly what we have.  Every time someone goes to a show expecting one thing only to find something else, it de-legitimizes our event.
I can't tell you how sick I am of the "Northeast Kingdom Reggae Festival" which, a few times now, has tried to capitalize on our event's reputation as well as that of the several-years defunct Vermont Reggae Fest.  These people advertise that they're going to have acts with huge name recognition, and in the end, you get one member of the original band, or more often, once you've paid and get to the show, they tell you "oh, they had to cancel".  It's a bunch of B.S. that ruins people's experience and makes them too cynical to want to go out to see more music.

Music fans and the bands they follow should be protected from fraudulent acts.

Also, if you haven't been in Vermont that long, you may remember a bar that opened up in downtown Burlington called Sha-Na-Na's. They were called on the fact that they were using the name of a well-known band, so they changed the name to Sh-Na-Na's.
