Dem Leaders Drop Vermont Yankee Provisions of H.520 Prior to Climate Change Summit With Governor

The AP is reporting that Governor Douglas, Senator Shumlin, and House Natural Resources Chair Representative Robert Dostis are scheduled to meet tomorrow to discuss the global warming bill and the upcoming July veto-override session. Right on the heels of that announcement comes this from the Senate Prez-Pro-Tem's office:

The leadership of the Vermont House and Senate today announced that in light of Governor Douglas's veto of H.520 and his objection to the source of funding for the bill, Senator Shumlin and Speaker Symington will propose a suspension of the rules during the veto override session on July 11 to consider the same bill with the funding for an all fuels efficiency utility removed. Since the legislation vetoed by the governor stipulates that funding for the all fuels efficiency utility will be needed starting in 2009, this proposal would allow the legislature to consider how to fund the utility when it reconvenes in January.  In the meantime, the planning process for the utility, as well as other key provisions in H. 520, will be enacted

This announcement is one of two things; either another example of our legislative leadership running to move the goalposts and compromise before negotiations have even begun... OR... a(n attempt at a) savvy move to put the Governor on the defensive, and put the media focus of tomorrow's meeting squarely on the content of the bill and not the "dreaded" funding scheme vis-a-vis Vermont Yankee.

My money's on the latter, but its risky. Still, the papers and internet are replete with conservatives claiming that they'd be all for this bill with a different funding scheme. This calls their bluff, and leaves them nowhere to hide if they really are global warming deniers. It also puts the BS to the GOP nonsense line that the bill is all about "getting" Vermont Yankee.

Unfortunately, it also leaves the Dems nowhere to go in a July compromise, but to take actual policy content out of the bill. It's a good ploy, but the risk seems perhaps disproportionate and the timing dangerously off. We'll see. Legislative Leaders Propose Modification to H. 520

The leadership of the Vermont House and Senate today announced that in light of Governor Douglas¹s veto of H.520 and his objection to the source of funding for the bill, Senator Shumlin and Speaker Symington will propose a suspension of the rules during the veto override session on July 11 to consider the same bill with the funding for an all fuels efficiency utility removed. Since the legislation vetoed by the governor stipulates that funding for the all fuels efficiency utility will be needed starting in 2009, this proposal would allow the legislature to consider how to fund the utility when it reconvenes in January.  In the meantime, the planning process for the utility, as well as other key provisions in H. 520, will be enacted as stipulated by the bill.  Senator Shumlin and Representative Robert Dostis, Chair of the House Natural Resources Committee, are meeting with Governor Douglas tomorrow to inform him of this proposal.
 
"This bill represents an extraordinary opportunity to save Vermonters money and create jobs while addressing global climate change, and we owe it to  Vermonters to make it law,² said Senator Shumlin. ³We have always said that to have a real impact, this bill needs funding, and we still believe that. We also believe that the provisions of this bill are too important not to pass right now, and that when the legislature reconvenes in January, we can work on the funding source.  We continue to feel strongly that the source of funding in this bill ‹ an adjustment to the property tax handout for Entergy that would still give them the same preferential tax treatment as other electric generators like wind ‹ is fair and just.  While we¹re disappointed that the governor disagrees, that is a conversation we can resume next year."
 
Chairman Dostis added, "My committee, along with the Senate Natural Resources Committee, worked hard on this legislation, and we produced a great bill. We have heard from opponents about their objections to the funding source, and while we don¹t come to the same conclusion, we believe there is too much good in this bill for it not to become law.  From incentives for renewable energy generation to the expansion of net metering and the creation of a model energy efficiency utility, this bill is important in addressing rising energy costs and promoting Vermont's energy independence. We look forward to hearing the governor¹s response and working with our legislative colleagues to get this bill passed."

You know I felt uncomfortable with the initial VY tax proposal, but came around when it was changed to provide parity with wind projects on property tax.<>  I thought that was a reasonable move and took away the appearance that Dems were just trying to score a few points with the base on VY.<><>  

<><><>This latest move looks kinda risky to me.  A classic case of playing both sides against the middle with the likelihood of getting squashed.  The Dem base will sense a cave-in and the right never believed in the the bill in the first place.  <>

<>Worse still, if the bill goes through now it will be a Douglas victory.  He can claim that he prevented yet another Democratic tax hike.  Adds nicely to his narrative.

And JD, I appreciate your cynicism, but this is obviously a strategic play and not a "run screaming" moment. That's not to say it's good strategy. In fact, the more I think about it, the more bothered I become. This is all they had as a gimme to take control of the argument and yet preserve the bills content. Two weeks is an eternity of news cycles for something like this. Why did they feel the need to do this now, just to get ahead of the media curve on a meeting that will be all but forgotten when the veto session opens? I think this is an example of legislators being way too plugged into their own legislative world to have a good sense of strategy and timing in the public arena. It may get some good play in the shortest of terms, but it means they enter the veto session disarmed, and likely (once again) to have their base of supporters calling for their heads. A lot of people have been working hard to drum up support and momentum for this bill, and many of those people are likely to feel now that they had the rug pulled from under them and that it was all for nothing (and they'll be waiting for the other shoe to drop). Strategy, yes. Good strategy, I doubt it. Maybe I'll be proven wrong if Douglas walks out saying he'll sign it, but I seriously doubt it. the guy has let his real feelings on climate change slip plenty of times. He'll just find another face-saving excuse. When it comes to the game of politics and message, why does our team always seem to be all thumbs? I don't get it.

So Douglas thinks they're being "irresponsible" (0.00 / 0)

According to WCAX:

Douglas has proposed an alternative energy efficiency program that he says would produce the same savings without a tax.   The democrats want to have the same bill they passed during the session with out the Yankee tax, and the governor late Tuesday claims that's irresponsible.

There's not much more there, and I don't know where they're getting it, but not surprisingly Douglas is jumping on this right away.  Also interestingly (and if this is a concidence I'm a squirrel), the Gov's official website has it's top headline as "Gov. Douglas Urges Federal Action on Emissions", posted today no less.  Say what you will about ol' Douggie, but he certainly plays the game well.  Too bad he'd rather fawn over a giant, out of state corporation than actually save the people of the state money or do something about greenhouse gasses.

I've talked to a lot of people on our side who are definitely not sold on the VY tax. The R's have definitely done a good job of spinning this one. Still, It's hard to say that it's a good idea to announce that you're giving in on the one big point two weeks before you go in to negotiate.

 

What do we get if there is no deal, and what does Douglas get if there is one? I don't see how we benefit.

 

Better to have people label you a fighter than a loser. 



The Battle Was Already Lost... (0.00 / 0)

The "Tax" on Vermont Yankee is, as SPS points out in HIS commentary, really just a move to establish parity between the taxes that Wind Energy pays and the lower taxes that VY pays.  The message "No Republican Tax Giveaways for Nuclear Energy" would have played well given enough time.

It's not a sexy topic, and getting the word out would have taken time- so no wonder Jack's friends were "not sold" ... we didn't take the time to sell them.

Unfortunately, when Gaye Symington chose to be intimidated by the hissing and puffing of the minority party, and NOT postpone this session until September, the battle for time to win hearts and minds was lost.....

...this current move just makes us look spineless... SPIN it how you want....many people I know are disappointed, to say the least. 

Also, since we won't pass the measure, it hardly matters...but by choosing to put this in place without any funding we open ourselves to the age old charge that we Democrats are fiscally childish...

All in all, this really has really got me down.

Now, I hear that Douglas has said he won't even meet.

So what can the leadership do now? Beg him to meet with them? Give up even more? How does this veto session bring about any accountability, now that the D leadership has caved and Douglas is still saying no?

 

This is pathetic.
